In July of 2009, James C. was arrested and charged with the Class X felony of “Possession with Intent to Deliver Heroin”. This charge carries with it a mandatory minimum of six years in prison. The charge was successfully overturned by filing a Motion to Suppress Evidence in order to hold a hearing for more information regarding relevant facts. During the investigation the attorney in question did before that hearing, it was discovered that the Chicago Police had illegally, unconstitutionally, and illegally stopped James C. as he was driving.
Due to this evidence being discovered, attorneys were able to argue that the stop itself was improper and the evidence collected afterwards was irrelevant. The judge in question granted the Motion to Suppress Evidence, and the case was ultimately dismissed.
